Birch Health & Wellness provides functional medicine, educational resources, and health coaching services to empower women with underactive thyroid and Hashimoto’s to restore energy, balance hormones, and support overall well-being, naturally and holistically.

Through my website (tokibirch.com), I offer digital resources, online courses, group programmes, private coaching, and functional health test interpretation services.

Please read these Terms & Conditions carefully before using this site or making any purchase. By accessing the site or purchasing a product or service, you are agreeing to these Terms & Conditions.

2. Important Client Terms of Engagement

About Birch Health and Wellness

Toki Birch is a Certified Functional Medicine Practitioner, Health Coach and Nutritionist. She is also a Certified SSP Provider.

Birch Health and Wellness asks clients to be aware of the following:

  • The scope of consultation services does not include diagnosis or treatment of newly presenting illness or disorder/s. If I, the client, suspect I may have an ailment or illness that may require medical attention, then it is my responsibility to consult with my GP.

  • Functional medicine approaches, nutritional consultation and lifestyle advice are not a substitute for conventional medical advice and/or treatment.

  • If your practitioner has serious concerns about your safety or the safety of another person, normal confidentiality may be lifted. You will be asked to provide your GP’s contact details, as someone they may contact.

  • Any mention of prescription medications during consultation is only for the purpose of providing a complete history of medications that the client is taking, not for review of the appropriateness of the medication. Any change in prescription or dosage of ongoing medications is a decision the client makes with his or her general practitioner/hospital specialist.

  • Birch Health and Wellness focuses on symptom management (alongside ongoing medical management of known conditions), attainment of optimum health and wellness, and prevention of illness, using lifestyle medicine modalities, to achieve optimal health. Supplementation may be advised, where deemed necessary, and your practitioner may receive a commission on these products.

  • Functional testing may be recommended, where deemed appropriate. Please note that any additional tests undertaken are charged separately by the respective labs. The purpose of functional testing is to evaluate nutritional, biochemical, or physiological imbalance and to determine any need for medical referral. Functional tests are not intended to diagnose disease.

  • Use of nutritional supplements may be safely recommended for clients already taking prescribed pharmaceutical medications, but interactions can occur between certain medications and certain supplements. For this reason, it is important to keep all of your healthcare providers fully informed about all medications and nutritional supplements you may be taking.

  • While people generally experience greater health and wellness as a result of embracing a healthier attitude, lifestyle, and diet, Birch Health and Wellness does not promise or guarantee protection from future illness.

  • The degree of benefit obtainable from consultation may vary between clients with similar health problems and following similar programmes.

  • Individual Holistic Health Programmes are usually offered for a minimum of 6 month periods.

The Client Understands and Agrees to the Following:

  • I am responsible for contacting my GP about any new health concerns.

  • If I am receiving treatment from my GP, or any other medical practitioner, I should tell them about any management plan or nutritional strategy provided by Birch Health and Wellness.

  • It is important that I tell Birch Health and Wellness about any medical diagnosis, medications, herbal medicines, or food supplements I am taking, as this may affect my management plan.

  • If I am unclear about the agreed nutrition programme/supplement/recommended amounts/time period, I should contact Birch Health and Wellness promptly for clarification.

  • I understand that the advice provided is personal for me and might not be appropriate for others.

  • I must contact Birch Health and Wellness should I wish to continue any specific supplements/food plans for longer than the original agreed period, to avoid any potential adverse reactions.

  • Recording consultations using any form of electronic media is not permitted.


3. Mini-Course Specific Terms & Conditions

Scope. These terms apply to all short-form, self-paced digital courses sold by Birch Health & Wellness (“Mini Courses”) and form part of these Terms & Conditions.

Licence & Access. On purchase you receive a non-transferable, revocable, single-user licence for personal educational use only. Account sharing, copying, redistributing, publishing, or reselling any materials is prohibited.

Access Window. Access is provided digitally via our learning platform. Unless stated otherwise on the sales page, access is provided for at least 12 months from purchase. We may update or migrate platforms without materially reducing access.

Educational Use Only. Mini Courses provide general education. They do not diagnose, treat, cure, or prevent disease and are not a substitute for medical advice. Consult your GP or specialist before changing medication, supplements, or treatment.

No Personal Support. Mini Courses do not include personalised medical advice or 1:1 support unless expressly stated on the sales page.

Results Vary; No Guarantees. Outcomes depend on individual factors. No specific results are guaranteed.

Payments, Plans & Chargebacks. Full payment is due at checkout unless a payment plan is offered. If on a plan, all instalments must be completed. Unauthorised chargebacks constitute a breach of these Terms and may result in suspended access and referral of unpaid balances for collection.

Refunds. Due to the digital nature of Mini Courses, all sales are final.

Acceptable Use. Do not attempt to circumvent paywalls, scrape content, or share downloads. Material breaches (including piracy or unauthorised sharing) may result in access revocation without refund.

Technical Requirements. You are responsible for suitable internet, device, and software. We are not liable for access issues caused by your equipment or ISP.

Taxes. Prices may be inclusive or exclusive of VAT as stated at checkout. Where applicable, VAT is charged under UK/EU rules.

Age. Mini Courses are intended for adults. By purchasing, you confirm you are 18+.


4. Intellectual Property

All content on tokibirch.com and within all digital products, programmes, and services is owned by Birch Health & Wellness and may not be copied, shared, or used commercially without written consent.

You may view, download, and print content for your own personal use only. You may not reproduce, distribute, or modify any content for commercial or public use without my prior written consent.


5. Payments & Cancellations

Payments

  • Payment is required at the time of booking.

  • Payment plans can be arranged if necessary.

  • Programmes and digital products are non-refundable and subject to the agreed programme time limit.

  • Payments are processed securely via Stripe, PayPal, Apple Pay, or Google Pay.

Non-refundable Products & Services

The following are non-refundable:

  • Digital downloads (meal plans, recipe books, guides)

  • Online mini-courses - all short-form, self-paced digital courses (Slim & Thrive, Endless Energy, 7-Day Challenge, Step-by-Step to Gluten-Free in 14 Days)

  • Group programmes (including, VIP upgrades of mini-courses, Thyroid Reignite)

  • 1-1 private coaching programmes (including Energised Thyroid, other 1-1 private coaching)
  • Functional Testing & Interpretation services

Payment Failure

If your payment fails or is reversed, access to the product or service may be suspended until payment is successfully processed.

Cancellations

  • Please provide at least 48 hours' notice for any cancellations/changes to your appointment times.

  • Appointments cancelled or moved within 48 hours may be forfeited.

  • If you need to cancel/reschedule, please email support@tokibirch.com.


6. GDPR / Data Protection

Birch Health and Wellness keeps a record of your name, contact details and dates and times of appointments on an encrypted database.

Your practitioner is required to keep brief notes about the focus of your work. These are kept securely within the password-protected GDPR and HIPAA Compliant Practice Management system Practice Better.

Any reports produced by Birch Health and Wellness to evaluate the service contain anonymised data and will not contain any identifying information of clients.

As a UK-based business, Birch Health & Wellness complies with UK GDPR regulations. Where clients are based outside of the UK, I adhere to applicable data protection standards, including utilising systems that meet HIPAA compliance where relevant.

7. Third-Party Resources

From time to time, I may share third-party links or resources. Birch Health & Wellness is not responsible for the content, accuracy, or availability of these external resources.

From time to time, Birch Health & Wellness may recommend third-party products or services, and may include affiliate links in website content, emails, or programme materials.

This means that if you choose to purchase through one of these links, Birch Health & Wellness may earn a small commission — at no additional cost to you.
I only recommend products and services that I genuinely trust and believe may support your health and wellness journey.

Birch Health & Wellness is not responsible for any delays or failure to perform due to causes beyond my reasonable control (force majeure), including but not limited to: internet outages, hosting failures, strikes, illness, or acts of God.

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of England & Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.

Birch Health & Wellness is committed to providing a high-quality service to all clients. However, if you feel that this has not been the case, please do let us know, so that we may improve our service going forward.
